Terms & Conditions – The Creative Lab

A. Introduction / Acceptance
By accessing or using any services provided by The Creative Lab, you agree to these Terms & Conditions. These terms apply to all service packages, content, creative assets, and ad management services offered through our website or via direct engagement.
 
B. Services Provided
•    We provide social media management, content creation, and ad management for Facebook and Instagram.
•    Clients may provide their own photos, videos, or brand assets to include in posts or reels.
•    We do not guarantee specific results such as sales, follower growth, leads, or engagement, as performance depends on audience behaviour, market conditions, competition, and platform algorithms.
•    All services depend on timely and accurate inputs from the client.
 
C. Payment Terms
•    Package payments must be made in full before services begin.
•    All plans are billed monthly on a recurring basis.
•    The billing cycle begins on the date payment is received (e.g., if payment is made on the 5th, the next billing date is the 5th of the following month).
•    Ad budget is separate and must be paid directly by the client to the advertising platform (Meta/Google).
•    Meta charges GST on ad spend. This GST is charged by Meta directly and is not controlled by The Creative Lab.
•    Advertising platforms may sometimes spend slightly above or below the selected daily budget. This is standard and outside of our control.
•    No refunds are issued once the monthly service period has started.
 
D. Service Delivery Timelines
•    Once an order is placed and confirmed, The Creative Lab will begin the content creation process.
•    Posts, reels, and short-form videos are typically delivered within 72 hours after receiving all required materials (brand assets, footage, brief, etc.).
•    Delays caused by incomplete inputs, revision requests, or pending approvals may extend delivery timelines.
•    Urgent or express delivery may require additional charges.
 
E. Revisions
•    Unlimited revisions apply only to Canva-based posts and reels.
•    Revisions do not include major concept changes or new creative directions outside the agreed package scope.
•    Additional revisions may extend delivery timelines.
 
F. Intellectual Property & Content Use
•    All content created by The Creative Lab becomes the client's property upon full payment.
•    Templates, design systems, or proprietary formats created by The Creative Lab may not be redistributed or resold.
•    Delivered content may be used by the client on their social media channels and marketing materials.
•    Third-party stock assets remain subject to their own licensing rules.
 
G. Client Responsibilities
Clients must:
•    Provide brand materials, logo files, footage, and required information.
•    Respond to messages and approvals in a timely manner.
•    Provide accurate details for ad campaigns, creative direction, and business information.
•    Understand that delays in communication may affect content delivery and campaign performance.
 
H. Third-Party Support & Tools
•    The Creative Lab may collaborate with third-party service providers such as freelancers, partner agencies, editors, and designers when required for project completion.
•    All third-party collaborations are supervised by The Creative Lab to maintain quality and consistency.
•    We may use a variety of third-party platforms and tools to deliver services efficiently. These may include, but are not limited to:
Canva, Meta Pixel, Meta Conversions API, Meta Ads Manager, AI-based content creation tools (e.g., AI video editors, AI image generators, AI copywriting tools), analytics tools, scheduling tools, website plugins, and design software.
•    These tools are governed by their own Terms of Service and Privacy Policies.
•    By engaging with our services, the client agrees to the use of these tools as necessary for service delivery.
•    The Creative Lab does not share personal or sensitive client data beyond what is required for service execution.
 
I. Liability & Disclaimers
•    The Creative Lab is not responsible for platform-related issues such as downtime, bugs, or algorithm changes by Meta, Instagram, or Facebook.
•    Ad performance depends on user behavior, audience interest, market conditions, and many external variables.
•    While campaigns may be optimized for desired outcomes, we cannot guarantee sales, followers, or conversions.
•    Unexpected ad charges, spending fluctuations, or reporting delays from Meta/Google are not within our control.
•    The Creative Lab is not liable for losses arising from incorrect information provided by the client.
 
J. Confidentiality
•    All client information, brand assets, private communication, and campaign data are handled confidentially.
•    No such information will be shared with anyone unless required for service delivery or mandated by law.
 
K. Termination
•    Services may be terminated if payment is not received or if terms are violated.
•    Clients may cancel services at any time, but no refunds are provided for the ongoing month.
•    Work stops immediately upon termination.
 
L. Governing Law
These Terms & Conditions are governed by the laws of India, specifically Karnataka State.
 
M. Changes to Terms
•    The Creative Lab may update these Terms & Conditions at any time without prior notice.
•    Clients are responsible for reviewing updates periodically.
 
N. Cookies & Website Usage
By using our website, you consent to the use of cookies for analytics, performance improvement, and personalized content delivery.
 
O. Dispute Resolution
•    In case of any dispute, both parties agree to first attempt a mutual resolution. Any unresolved disputes shall be subject to the jurisdiction of Bengaluru, Karnataka, India.
 
P. Canva & Third-Party Asset Usage
•    Content created using Canva or third-party assets is included as part of the client’s deliverables.
•    Third-party licensing rules apply for stock images, audio files, graphics, and templates.
•    Clients may not resell Canva templates or proprietary creative frameworks.
•    Providing original media is encouraged for full licensing clarity.
 
Q. Responding to Comments & Messages (Add-On Service)
•    Responding to comments and direct messages is not included in any package by default.
•    This service is available only as an add-on if the client chooses to purchase it.
•    The add-on includes handling up to 10 comments per day and 10 direct messages per day.
•    Responses will be handled only during business hours (Mon–Fri, excluding national holidays).
•    Any volume beyond the add-on limits will require an upgraded add-on or additional charges.
•    Clients must provide clear information, FAQs, or guidance to ensure accurate responses.
